By accessing or using Riskapture's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Riskapture provides a cloud-based governance, risk, and compliance (GRC) platform that helps organizations manage their risk, compliance, and governance activities. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring all users comply with these terms

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to any systems
• Transmit any malicious code or interfere with the service
• Resell or redistribute the service without authorization
• Use the service to store or transmit infringing content

5. Data Ownership

You retain all rights to your data. By using our service, you grant us a limited license to process your data solely for the purpose of providing the service. We will not access your data except as necessary to provide support or as required by law.

6. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly set forth herein. We may change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.

7. Intellectual Property

Riskapture and its licensors retain all intellectual property rights in the service. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RISKAPTURE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

9. Indemnification

You agree to indemnify and hold Riskapture harmless from any claims, damages, or expenses arising from your use of the service or violation of these terms.

10. Termination

Either party may terminate this agreement with 30 days' written notice. We may suspend or terminate your access immediately for violation of these terms. Upon termination, you may request export of your data within 30 days.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes by email or through the service. Continued use after changes become effective constitutes acceptance.
